HelloTeam, Inc., a Delaware Corporation, (“HelloTeam,” “we,” “us,” or “our”), respects your privacy and is committed to protecting it. This Privacy Policy outlines our privacy practices as it relates to websites operated by HelloTeam that link to this Privacy Policy (collectively, the “Website”) and the applications, integrations, mobile applications, and services offered by HelloTeam (collectively, the “HelloTeam Services”), and how you can exercise your privacy rights.

“You” may, depending on the context, be a Visitor or a User of one or more of the HelloTeam Services.

This Privacy Policy does not apply to Personal Information relating to HelloTeam’s employment or recruitment-related activities. HelloTeam is the leading all-in-one employee engagement and performance management platform designed to help organizations manage their talent. To support you and your team, we provide a hosted platform and related tools, including the HelloTeam web and mobile applications.

If you are resident in the European Economic Areas (“EEA”), UK or Switzerland, the controller of your Personal Information that we process for the purposes described in this Privacy Policy is HelloTeam, Inc., (doing business as HelloTeam).

When expressing interest in learning more about our offerings, you may provide us with Personal Information including, but not limited to, your full name, email address, phone number, employer, and job title. When using our Website, we may also collect Information about how you use our Website using cookies, pixel tags, and other similar technologies (collectively, “Cookies”). We use the Information you provide us to send you information that may be of interest to you, such as Information about our products and details on upcoming events. We may use the Information we collect about your usage of the Website to improve our Website or personalize your experience on the Website.

B. On our Service(s)

Your employer or an entity with which you have a relationship may subscribe to one or more of HelloTeam’s Services (“Customer”). HelloTeam may receive Information about you from the Customer or collect information from you under the direction of the Customer. Concerning Personal Information provided by a Customer or collected under the direction of a Customer, HelloTeam is the data processor, and the Customer is the data controller. If you are a user of our Service(s), you or Customer may provide us with information such as your name, a photo, email address, shipping address, job title, employment start date, birthday, and other Information you may share in your profile or that you may post to the Service. Some users of our Service(s) may also provide HelloTeam with a credit card or other payment information for billing purposes.

When using our Service, we may also collect Information about your use of the Service using cookies, pixel tags, and other similar technologies (collectively, “Cookies”) for user authentication purposes, to understand how users use the Service, and to provide technical support. We use the Information you provide to HelloTeam as a user of the Service solely to provide the Service and fulfill our obligations under the agreement we have with the Customer with which you have a relationship or as may otherwise be required by law. We may use the Information collected about how you use the Service for purposes of improving the Service.

We will retain your Information collected on the Service only as long as for as long as your account is active or as long as necessary to fulfill its obligations under its agreement with the Customer with which you have a relationship or other legal obligations.

4. Your Control Over Your Information

When acting as a controller, and depending on your location, your jurisdiction, and subject to applicable law, you may have the rights below with regard to the Personal Information we control about you. We will respond to your requests within the appropriate timeline under applicable law.

The right of access means that you have the right to request that we disclose what Personal Information we have collected, used and disclosed about you. You can do so at any time by contacting us using the contact details provided under the “Contacting HelloTeam” heading below.

The right of deletion means that you have the right to request that we delete Personal Information collected or maintained by us, subject to certain exceptions. The right to non-discrimination means that you will not receive any discriminatory treatment when you exercise one of your privacy rights.

While you cannot opt out of service-related emails if you are an account holder, as this is an essential part of the HelloTeam Services, you have the right to opt-out of marketing communications we send you at any time. Similarly, if we have collected and process your Personal Information with your consent, then you can withdraw your consent at any time. Withdrawing your consent will not affect the lawfulness of any processing we conducted prior to your withdrawal, nor will it affect processing of your Personal Information conducted in reliance on lawful processing grounds other than consent

5. Sharing of Information with Third Parties

We may utilize contractors, technology vendors, or other entities (“Agents”) to assist us in communications or in providing the Service. Agents will only have access to and the right to use Information as necessary to carry out the services they are performing for HelloTeam or as otherwise required by law.

If HelloTeam should ever merge with or get acquired by another organization, file for bankruptcy, or sell our assets or capital stock, we may transfer Information collected to a third party or the acquirer, and such entity may continue to use the Information in accordance with this Privacy Policy.

This Privacy Policy applies only to HelloTeam’s Website and Service. We may provide links to third-party websites on the Website or in other communications to you. Additionally, you may use third-party applications or services in conjunction with our Service. This Privacy Policy does not cover third-party websites or services that are not under our control. We encourage you to carefully review the terms of use, privacy policies, and any other legal documents applicable to such third-party websites, applications, or services before using them.

8. International Transfers of Information

Your personal information may be transferred to, and processed in the United States and in any other country where HelloTeam or its affiliates, subsidiaries or third party service providers maintain facilities or personnel.  These countries may have data protection laws that are different to the laws of your country (and, in some cases, may not be as protective). We follow applicable data protection laws when transferring personal data.If you are resident in or a visitor from the EEA, United Kingdom or Switzerland, we will protect your Personal Information when it is transferred outside of such locations by processing it in a territory which the European Commission has determined provides an adequate level of protection for Personal Information; or otherwise implementing appropriate safeguards to protect your Personal Information, including through the use of Standard Contractual Clauses or another lawful transfer mechanism approved by the European Commission.

9. California Consumer Privacy Act (CCPA) Sale of Personal Information Notice

As mentioned above, HelloTeam may provide third parties with certain personal information to provide or improve our products and services, for example to deliver products or services at your request. In such cases, we require those third parties to handle the information in accordance with applicable laws and regulations. HelloTeam does not sell personal information to third parties (pursuant to CaliforniaCivil Code §§ 1798.100–1798.199, also known as the California Consumer Privacy Act of 2018), nor does HelloTeam share personal information with third parties for their direct marketing purposes (pursuant to California Civil Code Sec.1798.83).

10. Information About Minors

Our website and services are not targeted at children under sixteen (16) years of age. As such, HelloTeam does not process or disclose Personal Information of minors under sixteen years of age. 11. Data Processing Addendum

Where applicable, HelloTeam processes information in accordance with our Data Processing Addendum (“Data Processing Addendum”, “DPA”). Where the terms of this privacy policy and the DPA are in conflict, the DPA shall govern. 

We strongly encourage every user of the HelloTeam Service(s) to review the Data Processing Addendum, which contains information such as country/region specific data privacy regulation information.

12. Changes to this Privacy Policy

We periodically update this Privacy Policy. We will post any privacy policy changes on this page and, if the changes are material, we will provide a more prominent notice by sending you an email notification, or other appropriate means. While we will notify you of any material changes to this Privacy Policy prior to the changes becoming effective, we encourage you to review this Privacy Policy periodically. When we do change the Privacy Policy, we will also revise the “last updated” date at the top of the Privacy Policy and may notify you or post a message on the Website and/or through the Service. Your continued use of the Service constitutes your agreement to the current version of the Privacy Policy.
